hit and run 'claimed' stolen car wrote off my golf. where do i stand?

    Crap news!

    1. If you have space, get your car back from the recovery place. It looks beyond repair, but you can break it to get some more cash back in.

    2. You can claim off the Mondeo insurance, if your insurance company won't follow it up, there are specialists out there.

    They wont let him have it back sadly, as only a registered breakers can dismantle a car if its a CATB.

    So sorry to hear this. The Mk2 looked really nice pre accident. [:^(]

    I don't understand how the mondeo's owner/insurer are liable. An insurance policy doesn't cover any driver with or without the policyholder's permission

    Don't get me wrong I hope you don't have to claim on your own insurance & don't lose out, you're obviously a totally innocent victim here, however if my car was nicked I wouldn't be happy if my insurance company paid for damage caused to someone elses car.

    It was stolen with the keys. There has to be a liability somewhere, and the owner of the car is obviously first port of call.

    I understand what you're saying in this particular case where it seems highly likely that she lent the car to somebody, if that is the case then she is is allowing, causing or permitting the offence so may be liable in a civil court for damages, however I can't see any liability with her insurance company.

    the thief handed himself in to the police and has been charged. he admitted to taking his mates car without consent and told the police all he remembered was smashing in to the red golf!

    he has no licence, or insurance. court next week

    where do you think this leaves me?

    I think in this case a civil case against the person would be justified. In most cases I'd say the opposite as this is the reason most of us buy insurance - but when you don't buy insurance I'd say go for the perp. Problem with that is you'll probably win, but get payment at a rate of 10 a month for 100years or something paltry.

    If you have Uninsured Loss Recovery or Legal Cover on your policy, use that and do it before he goes to court.

    If there is a liable person, then they can claim the money back.

    is that for the excess or the full claim? as i assume the 18yr old driver will not be able to afford the repair of the yeti, and the two written off cars.

    im sure it'll go down the can afford 5 a month for the next 10 years route

    Just a thought... was the accident with the 'stolen' car heading towards the owner's house or away from it? How far away was it. How many car thieves would be heading towards the place they nicked the car from? That would suggest to me that the owner knew about it - down the garage for some fags or rizlas after a beer session?

    You might want to think about that in event of a complaint to the PCC, or a private prosecution.

    mike, it was heading away from the house. it was classed as a twoc.

    the case has now been moved to crown court.

    i was paid out more than i imagined for my golf. i just hope this is picked up by the other insurer. doubt it, but i paid extra for protected no claims

    If its been refered to crown court and he is found guilty (likely as he handed himself in) I rather suspect he will get time at Our majesty's pleasure.

    the little turd got 6 months on a tag (7-7), 280hrs community service, a years suspended sentence and 1200 court costs. 250 of which is my excess. As he is unemployed he can only afford to pay me 30 a month. and as i am thrid in the payment line, it won't be until 2013!

    my insurer (greenlight/highways) assure me that the stolen cars insurer have a duty to cover the vehicle even if stolen.

    my only worry is that my renewal is next month and a unresolved claim will be loaded.

    the usual compare websites are coming out with reasonable quotes, but they do not cover mods.........

    i have a ko4001 planned!
